3. User Accounts

9. Limitation of Liability

Our total liability for any claims arising from or related to these Terms or the Services shall not exceed the amounts paid by you to Pursivic during the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Pursivic and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Services or violation of these Terms.

11. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after such changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Dallas County, Texas.

14. Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and Pursivic regarding the Services.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.
Waiver: Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
Assignment: You may not assign these Terms without our prior written consent.
